New Massachusetts Home Inspection Rules: What Buyers and Sellers Need to Know

Beginning October 15, 2025, new home inspection rules will take effect in Massachusetts. These regulations are designed to protect buyers’ rights to a home inspection and reduce the pressure to waive this step in a competitive market.

The changes are significant- and so are the penalties for not complying. This makes it critical for buyers and sellers to work with a real estate professional who understands exactly what this means.


The Key Changes

  • Inspections Cannot Be Waived. Buyers must have the opportunity to conduct a home inspection. Sellers and agents cannot require, encourage, or accept offers that include a waived inspection contingency.
  • Written Disclosure Required. A new document, signed by both parties, will confirm that the buyer is aware of their inspection rights. This must be provided before a contract is signed.
  • No Workarounds. Contract provisions that make inspections meaningless, such as extreme timing restrictions or penalties for withdrawal, are not allowed.
  • Limited Exceptions. Family sales, foreclosures, estate planning, and new construction covered by a one-year warranty are exempt.
  • Enforcement Matters. Violations may be treated as consumer protection issues, exposing parties (and their agents) to legal and licensing consequences.
